Privacy Policy
This Privacy Policy explains how SnowDay LLC and Fizzix LLC, each of which owns an interest in the Fizzix brand and business (collectively, “Fizzix,” “we,” “us,” or “our”), collect, use, disclose, and protect personal information in connection with fizzix.com (the “Site”) and communications initiated through the Site.
The Site does not currently use analytics or advertising pixels, provide ecommerce, or operate an email or SMS signup. The visible signup fields are disabled and do not submit information.
1. Scope
This Policy applies to the public Site and to messages you choose to send using contact information posted on the Site. It does not apply to information collected independently at a physical point of sale, through an employer or job application process, by Pigeon Forge Snow outside the Site, or by a third-party website or service that has its own privacy policy.
2. Information we collect
Information you choose to provide. If you email or call us, we may receive your name, email address, telephone number, the contents of your message, and any other information you choose to provide. The Site does not currently accept account registrations, orders, payments, comments, or active email or SMS signups.
Information collected automatically. Like most websites, our hosting and security infrastructure may automatically record technical information when a page is requested. This may include an Internet Protocol address, browser and device type, operating system, requested page, date and time, referring page, and diagnostic or security information.
Aggregated or de-identified information. We may create aggregated or de-identified information that does not reasonably identify an individual and use it for operations, planning, security, or service improvement.
3. Cookies and browser storage
We do not currently use advertising cookies, analytics cookies, or cross-site tracking pixels on the public Site. WordPress may use short-lived browser session storage to test emoji support. Depending on browser support, WordPress may also request standardized emoji assets from WordPress.org. WordPress and our hosting stack may use technically necessary cookies or similar mechanisms for authenticated administrators, security, or core website operation.
If we later add analytics, advertising, signup, ecommerce, or other services that use additional cookies or storage, we will update this Policy and provide any choices required by applicable law before or when those services are enabled.
4. How we use information
We may use information to provide and operate the Site, respond to questions and requests, protect the Site and our business, investigate fraud or security incidents, improve operations, comply with applicable law, maintain records, and establish, exercise, or defend legal claims.
5. How we disclose information
We may disclose personal information to vendors that support website hosting, security, maintenance, email, information technology, records storage, and similar operational functions. We may also disclose information to professional advisers; when required by law or reasonably necessary to protect rights, property, safety, or security; as part of a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction; or with your direction or consent.
6. Sale, targeted advertising, and profiling
We do not sell personal information. We do not use personal information from the Site for targeted advertising across unrelated websites or for profiling in furtherance of decisions that produce legal or similarly significant effects. If these practices change, we will update this Policy and provide required choices before or when the change takes effect.
7. Data retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including operating and securing the Site, responding to requests, maintaining appropriate business records, resolving disputes, and meeting legal obligations. In deciding how long to retain information, we consider the amount, nature, and sensitivity of the information; the purposes for which it is processed; the potential risk of harm from unauthorized use or disclosure; and applicable legal, accounting, and operational requirements.
When information is no longer reasonably needed, we may delete, de-identify, or securely dispose of it, subject to backup cycles and legal requirements.
8. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information appropriate to its nature and the circumstances. No website, transmission method, or storage system can be guaranteed to be completely secure.
9. Your privacy rights and choices
Depending on where you live and subject to applicable exceptions, you may have the right to request confirmation of whether we process your personal information, access it, correct inaccuracies, delete it, or receive a portable copy. You may also have rights concerning sale, targeted advertising, or certain profiling. As described above, we do not currently engage in those three practices through the Site.
To submit a request, email hey@fizzixdirtysoda.com with the subject line “Privacy Request.” Describe the request and the relationship or interaction that may help us locate the information. We may take reasonable steps to verify identity and authority before responding. We will respond as required by applicable law.

If we deny a request and applicable law provides a right to appeal, reply to our decision with the subject line “Privacy Appeal” and explain the basis for the appeal. We will review and respond as required by applicable law. You may also use an authorized agent where permitted by law, subject to reasonable verification.
10. Children’s privacy
The Site is not intended to collect personal information from children under 13, and we do not knowingly collect such information through the Site. The visible signup fields are disabled. If you are a parent or guardian and believe a child under 13 has provided personal information to us, contact us so we can review and take appropriate action.
11. Third-party links and services
The Site includes links that can open third-party services, including Google Maps for directions, and links that can open your email or telephone application. We do not control the privacy or security practices of third parties. Information you provide to a third party is governed by that party’s terms and privacy policy. The Site does not currently embed Google Maps, social-media feeds, payment services, or third-party video players.
12. United States processing
Fizzix is based in Tennessee. Information covered by this Policy may be processed and stored in the United States, where privacy laws may differ from those in another country.
13. Changes to this Policy
We may update this Policy as our Site, services, or legal obligations change. We will post the updated Policy on the Site and revise the effective date. If required by law, we will provide additional notice or obtain consent for a material change.
